Start with a readiness check

1. Notice to vacate

Review the lease and deliver the required written notice. Texas law generally provides a three-day period unless the written lease sets a different period.

2. File the eviction suit

After the notice period expires, the landlord may file in the Justice Court precinct where the rental property is located.

3. Citation and trial

The constable serves the tenant and the court sets trial. Each side may present testimony, records, photographs, and defenses.

4. Judgment, appeal, and writ

A judgment does not authorize immediate self-help removal. Appeal deadlines apply, and possession is enforced through a court-issued writ and constable when legally available.
